Therapica Terms of Use

1. Acceptance of Terms

Welcome to Therapica. These Terms of Use ("Terms") govern your access to and use of the Therapica mobile application ("App") and website located at www.therapica.org (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use our Services.

2. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after such modifications constitutes your acceptance of the revised Terms.

3. Account Registration

3.1 Account Creation

To access certain features of our Services, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account. We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

You are solely responsible for all data, voice recordings, text, information, and other content that you upload, post, or otherwise transmit via the Services ("User Content"). You represent and warrant that:

  • You own or have the necessary rights to use and authorize us to use your User Content
  • Your User Content does not violate the rights of any third party, including intellectual property rights and privacy rights

By submitting User Content through our Services, you grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and transmit such content solely for the purpose of providing and improving the Services.

The Service and its original content, features, and functionality are and will remain the exclusive property of Therapica and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Therapica.

5. Prohibited Uses

You agree not to:

  • Use the Services in any way that violates any applicable law or regulation
  • Use the Services for any harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable purpose
  • Attempt to gain unauthorized access to any portion of the Services or any other systems or networks connected to the Services
  • Use the Services to transmit any viruses, malware, or other malicious code
  • Use automated means, including spiders, robots, crawlers, or data mining tools, to access, scrape, or download data from the Services
  • Interfere with or disrupt the integrity or performance of the Services
  • Attempt to decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of the App or any part thereof

The Services, including all content, features, and functionality, are owned by Therapica, its licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You agree not to copy, modify, create derivative works, publicly display, publicly perform, republish, download, store, transmit, sell, or otherwise exploit any of the material on our Services, except as expressly permitted by these Terms.

Any feedback, comments, or suggestions you provide regarding the Services is entirely voluntary, and we will be free to use such feedback, comments, or suggestions without any obligation to you.

7. Third-Party Services

The Services may contain links to third-party websites or services that are not owned or controlled by Therapica. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such content, goods, or services available through any such third-party websites or services.

8. Termination

8.1 Termination by You

You may terminate your account at any time by following the instructions in the App or by contacting us at berkaysuozer@gmail.com.

8.2 Termination by Us

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

8.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

IN NO EVENT SHALL THERAPICA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
  • ANY CONTENT OBTAINED FROM THE SERVICES
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
